Florida Eviction Defense and Case Consolidation Strategy
The provided sources detail the legal strategy and procedural requirements for Christopher Winans as he navigates a Pinellas County eviction lawsuit and a related small claims action. The materials outline how Judge Edwin Jagger ordered the opposing counsel, Patrick Boyle, to merge the small claims case into the primary eviction docket overseen by Judge Lorraine Kelly. Additionally, the texts evaluate Christopher’s defenses regarding wrongful rent rejection and waiver, explaining his obligations to submit proper evidence and maintain disputed rental funds for the Court Registry. Finally, the sources guide Christopher on properly serving new parties, such as Parkshore Management and Saran Gaines, to ensure all claims and counterclaims are successfully integrated under Florida law.
How do Florida landlord-tenant laws protect tenants against the wrongful rejection of rent?
- The Affirmative Defense of “Tender and Rejection”: A landlord cannot legally evict a tenant for non-payment of rent if the tenant validly tendered the rent payment on time and the landlord actively refused to accept or cash it. Physical evidence—such as rent checks returned uncashed, checks held by management without cashing, or postal delivery receipts—serves as concrete proof of tender and rejection, barring the landlord from claiming a failure to pay.
- The “Waiver” Defense (Florida Statute § 83.56(5)): Under Florida Statute § 83.56(5), if a landlord accepts a current rent payment while having knowledge of an alleged past non-payment or breach, the landlord legally waives their right to evict the tenant based on that prior default.
- Procedural Safeguards via Court Registry (Florida Statute § 83.60(2)): Under Florida Statute § 83.60(2), to avoid an immediate default judgment when rent is disputed or wrongfully rejected, a tenant must file a Motion to Determine Rent and attach documentation proving their payment attempts. Depositing the disputed funds into the Court Registry as directed by the judge fulfills the tenant’s statutory obligations and protects them while the court rules on the defense.
- Protection through Restrictive Endorsements: Writing explicit restrictive endorsements on rent checks (e.g., stating the check applies exclusively to current rent and not to disputed past balances) protects the tenant. If a landlord retains or returns a check with a restrictive endorsement uncashed, the court treats it as the landlord choosing not to process valid rent rather than a tenant default.
Do you need assistance understanding how enjoining these two cases will impact your overall legal strategy?
- Brings Saran Gaines into the Eviction Case Automatically: Because Park Manager Saran Gaines was named as a defendant in your small claims action, merging the cases automatically transfers her into the eviction lawsuit once Judge Kelly signs the order.
- Facilitates a Unified Counterclaim: Rather than juggling two separate lawsuits in different courtrooms, consolidation allows you to file a single Third-Party Counterclaim naming all three involved parties: Pacifica Seminole MHP, LLC, Parkshore Management, and Saran Gaines.
- Avoids Extra Process Server Fees: Waiting for Attorney Patrick Boyle to file the Motion to Enjoin (due by October 27, 2026) means you will not have to pay a process server to re-serve Saran Gaines individually, as she joins the record through the case transfer. Formal service of process will then only be needed for Parkshore Management if they are not yet part of the record.
- Prevents Conflicting Rulings: Consolidating the actions ensures that Judge Lorraine Kelly evaluates management’s overall course of conduct—including your affirmative defenses of tender and rejection and waiver—rather than treating the eviction in isolation.
- Preserves Your Financial Claims: Because Florida eviction actions follow expedited summary procedure, incorporating your small claims allegations as counterclaims ensures your damages and grievances are addressed before the lawsuit concludes.
- File a “Notice of No Objection”: Once Patrick Boyle files the Motion to Enjoin, you can submit a 1-page “Plaintiff’s Notice of No Objection to Defendant’s Motion to Enjoin” to help Judge Kelly approve the transfer quickly without a contested hearing.
- File the Unified Counterclaim: Immediately after the consolidation order is entered, file your consolidated Third-Party Counterclaim against Pacifica Seminole MHP, LLC, Parkshore Management, and Saran Gaines.
- Maintain Registry Funds: Regardless of consolidation, Florida Statute § 83.60(2) strictly requires you to keep the full disputed amount ($1,762.98 covering March 2025, September 2026, and October 2026) in your bank account, ready to deposit into the Court Registry the moment Judge Kelly issues a deposit order.
Do you have the corporate address or Registered Agent information for Parkshore Management ready?

1-page template for the Notice of No Objection
- On October 7, 2026, during a scheduled hearing before the Honorable Judge Edwin Jagger in Case No. 26-011919-SC, defense counsel Patrick Boyle acknowledged the existence of an ongoing eviction action between the parties, styled Pacifica Seminole MHP, LLC v. Christopher Winans, Case No. 26-00999-CO, pending in the County Court Division before the Honorable Judge Lorraine Kelly.
- Pursuant to Judge Jagger’s oral directive issued on October 7, 2026, Attorney Patrick Boyle was ordered to draft and file a Motion to Enjoin/Consolidate Case No. 26-011919-SC into Case No. 26-00999-CO.
- Plaintiff, Christopher Winans, formally advises the Court that he has NO OBJECTION to Defendant’s Motion to Enjoin or to the entry of an Order transferring and consolidating Case No. 26-011919-SC into Case No. 26-00999-CO before Judge Lorraine Kelly.
- Consolidating these matters promotes judicial economy, avoids duplicate proceedings, and allows all related claims, defenses (including tender and rejection), and third-party counterclaims to be resolved in a single proceeding.
- Wait for Patrick Boyle’s Motion: Monitor the public docket via the Pinellas County Clerk Public Viewer until Attorney Patrick Boyle files his formal Motion to Enjoin.
- Date and Sign: Fill in the current date, your contact details, and Patrick Boyle’s portal/mailing address.
- Submit to Court: File this document through the Florida Courts E-Filing Portal under Case No. 26-011919-SC (or directly with the Clerk of Court).
What are the next steps after filing the counterclaim?
- For Active Plaintiff (Pacifica Seminole MHP, LLC): Formal sheriff/process server service is not required because they are already an active party in the lawsuit. You only need to serve their attorney, Patrick Boyle, electronically through the Florida Courts E-Filing Portal or via certified mail.
- For New Parties (Parkshore Management & Saran Gaines): Because they are not currently parties to eviction Case No. 26-00999-CO, you must issue a formal summons and have a certified process server or Pinellas County Sheriff’s deputy hand-deliver a copy of the summons and Counterclaim to them.
- Note on Consolidation: If Judge Jagger’s consolidation order is signed prior to service, Saran Gaines transfers into the case automatically from the small claims suit. Parkshore Management will still require formal service through their Registered Agent (Paracorp Incorporated) or on local management in Pinellas County.
- As soon as hand-delivery is completed, the process server will provide you with a Return of Service document. You must file this document immediately with the Pinellas County Clerk of Court to establish on the official court record that all third parties received legal notice.
- Under Florida civil procedure, newly served third-party defendants have 20 days from the date they are hand-served to file an Answer, responsive motion, or defense to your Counterclaim.
- Registry Deposit Readiness: Keep the full disputed total of $1,762.98 (covering March 2025, September 2026, and October 2026 rent) available in your bank account.
- Monitor Docket Daily: Regularly check the Pinellas County Clerk Public Viewer for Case No. 26-00999-CO. The moment Judge Lorraine Kelly issues a registry deposit order or schedules a Rent Registry Hearing, you must deposit the cashier’s check into the Court Registry as directed to prevent a default judgment.
- Once all parties file their responsive pleadings, the case enters the discovery phase. You can issue written Requests for Production of Documents (such as internal property payment ledgers, check handling logs, and correspondence records) to support your claims and defenses before Judge Kelly.
How do I serve the summons on Parkshore Management’s registered agent?
- Obtain the Summons from the Clerk: After preparing your Third-Party Counterclaim, submit a Third-Party Summons form to the Pinellas County Clerk of Court for official issuance.
- Transmit to a Certified Process Server or Sheriff: Deliver the issued summons and a copy of your Third-Party Counterclaim to a certified process server or county sheriff.
- Serving the Registered Agent in Tallahassee: Under Florida Statutes § 48.081 and § 48.091, formal corporate service is executed on Parkshore Management’s designated registered agent, Paracorp Incorporated, located at 155 Office Plaza Dr., 1st Floor, Tallahassee, FL 32301. You can transmit the documents to a certified process server operating in Leon County (Tallahassee) to effectuate service.
- Alternative Local Service: Florida law also permits serving the summons directly on the property manager in charge at the principal local office in Pinellas County (Saran Gaines).
- Complete Hand-Delivery: The process server hand-delivers the summons and Third-Party Counterclaim to the registered agent or authorized local management personnel.
- File the Return of Service: Once hand-delivery is complete, the process server will provide an official Return of Service document. You must file this proof of service with the Pinellas County Clerk of Court to verify on the docket that Parkshore Management received formal notice.

What should be included in the Third-Party Counterclaim?
- Court Name & Case Details: County Court of the Sixth Judicial Circuit, in and for Pinellas County, Florida (Case No. 26-00999-CO, presided over by Judge Lorraine Kelly).
- Party Designation:
- Plaintiff/Counter-Defendant: Pacifica Seminole MHP, LLC
- Defendant/Counter-Plaintiff: Christopher Winans
- Third-Party Defendants: Parkshore Management and Saran Gaines.
- Party Identification: State that Christopher Winans is a resident/tenant residing at Lot #210 in Seminole Mobile Home Park; Pacifica Seminole MHP, LLC is the property owner; Parkshore Management is the operating management company; and Saran Gaines is the Park Manager.
- Venue & Jurisdiction: Affirm that the property is located in Pinellas County, Florida, and that the claims arise directly out of the tenancy governed by Florida Statute Chapter 723.
- Procedural Context: Note that pursuant to Judge Edwin Jagger’s order in Case No. 26-011919-SC, the small claims action has been enjoined/consolidated into Case No. 26-00999-CO.
- Alleged March 2025 Default: Note that management alleged a missing March 2025 payment ($622.98) 16 to 17 months after the fact in July/August 2026.
- Waiver via August 2026 App Payment: Detail that Pacifica Seminole MHP, LLC and Saran Gaines accepted and processed the August 2026 rent payment ($570) via their official payment app after asserting the March 2025 dispute, legally waiving their right to evict under Florida Statute § 83.56(5).
- Wrongful Rejection of September 2026 Rent: Explain that September rent (Check #2701 for $570) was tendered on time but returned uncashed via registered mail on September 10, 2026, alongside a demand letter for $1,192.98.
- Hold on October 2026 Restrictive Endorsement Check: Explain that October rent (Check #7200 for $570) was delivered via postal service with explicit restrictive endorsements (restricting payment solely to October 2026 rent for Lot #210), which management is currently holding uncashed.
- Count I – Wrongful Rejection of Rent / Violation of Florida Statute Chapter 723: Assert the affirmative defense and counterclaim of Tender and Rejection—a landlord cannot claim non-payment when they actively refuse validly tendered rent.
- Count II – Breach of Covenant of Quiet Enjoyment & Lease Agreement: Claim that improper refusal of rent, artificial default creation, and improper eviction notices constitute a material breach of the tenancy agreement.
- Count III – Statutory Waiver (FL Stat § 83.56(5)): Demand a court declaration that acceptance of August 2026 rent barred the landlord from seeking possession based on ancient 2025 claims.
- Count IV – Claims Transferred from Small Claims (Case No. 26-011919-SC): Re-assert the specific damages and grievances originally filed against Saran Gaines and Parkshore Management.
- Dismiss Pacifica Seminole MHP, LLC’s eviction complaint with prejudice.
- Declare that September and October 2026 rent was validly tendered and satisfied upon deposit into the Court Registry.
- Award actual damages, statutory remedies, and court costs against the Counter-Defendants.
- Order management to update internal account ledgers to reflect all payments as current.
- Attach Key Exhibits: Include copies of September Check #2701, the September 10 registered mail letter, the August app payment receipt, October Check #7200, and postal delivery confirmation receipts.
- Certificate of Service: Include a statement confirming service on attorney Patrick Boyle via the Florida E-Filing Portal, and attach the Return of Service for third-party summons served on Parkshore Management and Saran Gaines.
- Case Under Review: Case No. 26-011919-SC (Pinellas County, Small Claims Division)
- Plaintiff: Christopher Winans
- Presiding Judge: Judge Edwin Jagger
- Hearing Date: October 7, 2026 [1]
- Existence of Separate Case: The Defendant’s attorney, Patrick Boyle, acknowledged on the record that a separate eviction lawsuit has been filed against the Plaintiff (Christopher Winans). That eviction case is officially filed with the Clerk of Court as Case No. 26-00999-CO (County Court Division).
- Judicial Order to Enjoin: Judge Edwin Jagger ordered the Defendant’s attorney to draft and file a formal motion within 20 days (by October 27, 2026) to enjoin (consolidate/transfer) the small claims case (26-011919-SC) into the existing county court eviction case (26-00999-CO).
- Are you looking for help drafting a response to the upcoming motion once it’s filed?

- What to do: Check the eviction complaint to see how much unpaid rent Attorney Patrick Boyle is claiming. If rent is due, Christopher must deposit that exact amount with the Clerk of Court, plus any clerk fees, immediately.
- The Risk: If this money is not deposited into the court registry (or if a motion to determine rent is not filed immediately to dispute the amount), the court is required by law to enter an immediate default judgment of eviction without a hearing, regardless of how strong Christopher’s legal arguments or responses are.
- What to do: Once Patrick Boyle files the Motion to Enjoin, Christopher can file a brief, 1-page document titled “Plaintiff’s Notice of No Objection to Defendant’s Motion to Enjoin”.
- This signals to Judge Jagger that both sides agree on the transfer, which allows the judge to sign the order quickly without needing an aggressive hearing.
- What to do: Christopher should file his claims from the small claims case as a formal Counterclaim within the eviction case.
- Even though Patrick Boyle’s eviction action does not currently claim money, Christopher’s counterclaim ensures that his own grievances (e.g., security deposit disputes, illegal lease violations, or habitability issues) are preserved and must be ruled on by the judge before the overall litigation concludes.
- Did Patrick Boyle’s eviction complaint allege non-payment of rent, or is it an eviction for a lease violation/non-renewal?
- Has Christopher deposited any money into the Pinellas County Court Registry yet?
- Would you like a template for the Notice of No Objection to use once the attorney files his motion?
- If it was filed within the 5 days: It is procedurally acceptable.
- If it was filed late: Even if the motion is drafted perfectly, a judge is legally required to deny it and grant Patrick Boyle an immediate default eviction without a hearing. [1]
- If Christopher simply asked the court to figure out the number without attaching concrete proof or calculations, Patrick Boyle can ask the judge to strike the motion immediately. [1]
- Issue an Order: The judge may issue a written order stating exactly how much Christopher must deposit and give a strict deadline (often 24 to 48 hours) to pay it. [1]
- Set a Rent Hearing: The judge will schedule a brief “Rent Registry Hearing”. Note: This hearing is only to decide the deposit amount—the actual eviction defense will not be decided yet. [1, 2, 3]

- What to do: File a brief document titled “Notice of Supplemental Evidence in Support of Defendant’s Motion to Determine Rent.”
- What to attach: Photocopy of Check #7200, the registered mail receipt, and the tracking tracking delivery confirmation showing the park office received it. This prevents Attorney Patrick Boyle from claiming Christopher missed October’s rent during the ongoing lawsuit.
- What to check: Christopher needs to look at his official lease agreement and the eviction summons. If Patrick Boyle sued under the wrong corporate entity name, or if the park changed names without proper legal notice, Christopher’s attorney (or Christopher himself) can use this defect as a defense to dismiss the eviction complaint.
- Service on the Plaintiff: For Pacifica Seminole MHP, LLC, you do not need formal sheriff service. Because they are already active in the case, you only need to “serve” their attorney, Patrick Boyle, through the Florida Courts E-Filing Portal or via certified mail.
- Service on the New Parties: For Parkshore Management and Saran Gaines, you MUST provide formal service of process. Because they are not currently parties to this specific eviction case number, they must be served with a summons and a copy of your Counterclaim by a certified process server or a Pinellas County Sheriff’s deputy.
- Proof of Service: Once the process server hand-delivers the paperwork to Saran Gaines and the registered agent for Parkshore Management, they will give you a Return of Service document. Christopher must file this proof with the Clerk of Court to prove they were officially notified.
- Since she was a named defendant in your small claims action, the transfer of that case brings her along with it.
- Strategic Tip: To avoid paying extra process server fees right now, Christopher can wait for Patrick Boyle to file the Motion to Enjoin (due by October 27, 2026). Once Judge Lorraine Kelly signs the order merging the cases, all parties from the small claims suit are formally part of the record, making it much easier to file the unified Counterclaim.
- Do not wait passively: Even though a physical summons hasn’t hit your door yet for Case 26-00999-CO, the fact that you already filed a motion to determine rent on October 5 means you have waived formal service defects and submitted to the court’s jurisdiction. This was actually a smart defensive move to stop an immediate default.
- What’s Next: Check the docket daily on the Pinellas County Clerk Public Viewer. Judge Lorraine Kelly will first rule on your Motion to Determine Rent. She will either order a specific dollar amount to be paid into the Court Registry by a set date or schedule a brief “Rent Registry Hearing”. [1]
- Secure the rent money for March, September, and October in your bank account so you can deposit it the exact day Judge Kelly orders it.
- Wait for Patrick Boyle’s Motion to Enjoin to bridge the small claims case (and Saran Gaines) over to Judge Kelly’s docket.
- File your consolidated Counterclaim naming all three parties immediately after the consolidation is approved, and send formal summons to Parkshore Management.
- Do you have the corporate address or Registered Agent information for Parkshore Management ready for when you serve the summons?
- Has the mobile home park given you any written notice explaining why they refused the September and October checks?

- The “Waiver” Defense (Florida Statute § 83.56(5)): By accepting Christopher’s August 2026 rent payment via their official app after they knew about the alleged March 2025 missed payment, Pacifica Seminole MHP legally waived their right to evict him for any prior defaults. Under Florida law, if a landlord accepts current rent while knowing a tenant is in breach, they cannot use that past breach as a ground for eviction.
- The Restrictive Endorsement on the October Check: Christopher did exactly the right thing by writing strict instructions on Check #7200 (restricting it only to October 2026 rent). Because management is holding that check uncashed and has not returned it, they cannot claim Christopher failed to pay October’s rent. They are choosing not to cash it.
- What to file: A document titled Notice of Supplemental Evidence in Support of Defendant’s Motion to Determine Rent.
- What to attach as exhibits:
- A copy of the certified mail letter received on September 10, 2026, where they demand $1,192.98.
- A copy of the August 2026 payment receipt or bank statement showing the $570 app transaction went through successfully.
- A copy of the front and back of October Check #7200 showing the explicit restrictive endorsement text.
- The U.S. Postal Service tracking receipt proving the October check was delivered to the Park Office.
- March 2025 Rent = $622.98 (inferred from the math)
- September 2026 Rent = $570.00
- October 2026 Rent = $570.00 (currently sitting uncashed in their office)
- Total funds Christopher must have ready: $1,762.98. Christopher must keep this exact total sitting in his bank account. The moment Judge Kelly rules on his Motion to Determine Rent, he will likely have less than 48 hours to convert this into a cashier’s check and hand-deliver it to the Pinellas County Clerk.
- Tender and Rejection: He attempted to pay September and October rent on time, and the landlord refused to cash the payments.
- Waiver and Estoppel: The landlord accepted August 2026 rent, wiping out their legal capacity to evict based on a March 2025 dispute.
- Keep checking the online docket for Case No. 26-00999-CO daily to see if Judge Lorraine Kelly issues an order setting a rent hearing or establishing the registry deposit amount.
- File the Supplemental Evidence (the September 10th letter and August app receipt) immediately.
- Wait for the October 27 deadline for Patrick Boyle to file the motion to enjoin the small claims case, bringing Saran Gaines into this lawsuit.
- Would you like me to draft the exact text for the Notice of Supplemental Evidence so Christopher can file it with the clerk?
- Do you need a breakdown of how to look up Judge Lorraine Kelly’s specific courtroom procedures for handling registry deposits in Pinellas County?

THE LAW – BASE FORM A To Which It Stands: ” War at Lot 210
The War At Lot #210 – ‘To Which It Stands
Intro Presentation:
The provided legal documents outline a civil lawsuit in Pinellas County, Florida, involving a mobile home park resident and management over infrastructure defects and alleged harassment. The plaintiff, Christopher Winans, seeks to amend his initial small claims complaint and transfer the case to the formal County Court Civil Division because damages exceed eight thousand dollars. Key claims involve park owner Pacifica Seminole MHP and manager Saran Gaines for retaliatory practices, breach of good faith under Chapter 723 of the Florida Statutes, and intentional infliction of emotional distress. Court records detail procedural motions to deposit disputed rent into the court registry, overcome service of process challenges via the corporate registered agent, and secure injunctive relief against unjust eviction threats. Ultimately, the filings emphasize the plaintiff’s legal strategy to hold the corporate entities and individual manager accountable for bad-faith ledger manipulation and property neglect.

==================
Because your case is filed in Pinellas County but the registered agent (Paracorp Incorporated) is physically located in Tallahassee (Leon County), you must use a server with jurisdiction in Leon County. You have two primary options: using the official local Sheriff’s office or hiring a private certified process server. [1]
Option 1: Leon County Sheriff’s Office (Civil Process Unit)
The most straightforward option is to use the local Sheriff’s office. They handle out-of-county legal hand-deliveries regularly. [1]
- Phone: (850) 606-3450
- Office Address: Attn: Civil Division, 3333 W. Pensacola St., Suite 200, Tallahassee, FL 32304
- Mailing Address: P.O. Box 727, Tallahassee, FL 32302
- Email Contact: lcso_civil_warrants@leonFLSheriff.gov
- Requirements: You will typically mail them the original summons issued by the Pinellas clerk, a copy of the amended complaint, a copy for their records, and a service fee check (usually around $40.00, though you should call to verify exact out-of-county rates). [1, 2, 3]
Option 2: Private Certified Process Servers (Tallahassee Local)
If you prefer a private service for faster turnarounds or specialized communication, you can choose from the official Second Judicial Circuit Certified Process Server Directory or agencies certified by the Florida Association of Professional Process Servers (FAPPS): [1, 2]
- Accurate Serve of Tallahassee
- KD Process (James Kady)
- Nolan Process Servers (Michael Nolan)
- Phone: (850) 901-0000 or (850) 562-6058 [1]
- Golden Process Service
- Phone: (888) 766-7497
- Details: Offers specialized same-day delivery specifically targeted at corporate registered agents in Leon County. [1]
Pro-Tip: Do not reach out to these servers until after the Pinellas County judge explicitly signs the order granting your Motion for Leave to Amend and the Pinellas Clerk processes your newly issued “Amended Summons.” Once you have that official summons paperwork in hand, you can send it to your chosen server above.

IN AND FOR PINELLAS COUNTY, FLORIDA
PLAINTIFF NAME(S),
Plaintiff,
vs.
PACIFICA SEMINOLE MHP LLC,
Defendant.
CASE NO.: 26-011919-SC
DIVISION: Small Claims
PLAINTIFF’S MOTION FOR LEAVE TO AMEND THE COMPLAINT AND MEMORANDUM IN OPPOSITION TO DEFENDANT’S MOTION TO DISMISS
Plaintiff, [Your Name], respectfully moves this Court pursuant to Florida Rule of Civil Procedure 1.190(a) and Florida Small Claims Rules for an Order granting leave to amend the initial Statement of Claim. In support, Plaintiff states:
- Plaintiff filed the initial Statement of Claim in this action on [Date you filed].
- Defendant filed a Motion to Dismiss alleging improper service of process, noting that service was delivered directly to the physical business location rather than to Defendant’s designated Florida Registered Agent.
- Plaintiff recognizes this technical defect and seeks to cure the service issue immediately. Justice requires that the case be decided on its merits rather than a technical service error.
- Leave to amend “shall be given freely when justice so requires” under Fla. R. Civ. P. 1.190(a).
- Granting this motion will not prejudice the Defendant, as the case is in its earliest stages, no trial date has been set, and the amendment serves only to properly identify and serve the correct Registered Agent entity.
- Attached hereto as Exhibit A is the proposed Amended Statement of Claim correctly identifying the Defendant and its Registered Agent for formal service of process.
WHEREFORE, Plaintiff respectfully requests this Court enter an Order:
- Denying Defendant’s Motion to Dismiss;
- Granting Plaintiff leave to file the attached Amended Statement of Claim; and
- Allowing Plaintiff an additional 120 days to execute proper service of process upon the Defendant’s Registered Agent: Paracorp Incorporated, 155 Office Plaza Dr, 1st Floor, Tallahassee, FL 32301.
Dated: October 1, 2026.

IN THE COUNTY COURT OF THE SIXTH JUDICIAL CIRCUIT
IN AND FOR PINELLAS COUNTY, FLORIDA
CHRISTOPHER L. WINANS,
Plaintiff,
vs.
SARAN GAINES, Individually, and
PACIFICA SEMINOLE MHP LLC,
Defendants.
CASE NO.: 26-011919-SC
DIVISION: County Civil Division (Transfer Pending)
JUDGE: EDWIN JAGGER
PLAINTIFF’S FIRST AMENDED STATEMENT OF CLAIM
Plaintiff, Christopher L. Winans, sues Defendants, Saran Gaines, individually, and Pacifica Seminole MHP LLC (doing business as Seminole Mobile Home Park), and alleges:
- JURISDICTION AND VENUE
- This is an action for damages, statutory violations, and injunctive relief that exceeds the $8,000 jurisdictional limit of the Small Claims Division due to compounding, active structural and infrastructure damages. Pursuant to Florida Small Claims Rule 7.100(d), this action is subject to immediate transfer to the formal track of the County Court Civil Division.
- Plaintiff Christopher L. Winans is a resident of Pinellas County, Florida, and owns a mobile home located on Lot #210 within the Seminole Mobile Home Park at 5015 Seminole Blvd, Seminole, FL 33772.
- Defendant Pacifica Seminole MHP LLC is a Florida limited liability company doing business in Pinellas County, Florida, and is the owner of the park [L19000250486].
- Defendant Saran Gaines is a resident of Pinellas County, Florida, and is the physical park manager. She is sued in her individual capacity. The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts, harassment, or bad-faith actions (Vesta Construction and Design, LLC v. Lotspeich & Associates, Inc.).
- GENERAL ALLEGATIONS: INFRASTRUCTURE DEFECTS
- Plaintiff’s tenancy is governed by Chapter 723, Florida Statutes (The Florida Mobile Home Act).
- Under Florida law, the park owner has a non-delegable duty to maintain the park’s common areas and infrastructure in good, safe working order.
- The Defendant’s property suffers from systemic, severe infrastructure issues, including but not limited to, systemic electrical defects posing immediate hazards, plumbing failures, and structural damages directly impacting Lot #210.
- These active, compounding infrastructure damages place the true amount in controversy above $8,000, invoking the formal track of the Florida Rules of Civil Procedure pursuant to Florida Small Claims Rule 7.020(b).
III. FACTUAL ALLEGATIONS: FABRICATED DELINQUENCY & HARASSMENT
- On September 23, 2026, Plaintiff filed a motion to securely hold disputed lot rental funds due to these unaddressed infrastructure defects.
- In retaliation, Defendant Saran Gaines fabricated a fraudulent one-month lot rent non-payment claim regarding Lot #210 for the month of March 2025—a period spanning 17 months prior.
- Defendant Gaines first informed the Plaintiff of this alleged missing March 2025 rent on July 28, 2026.
- Defendant Gaines has produced a photocopy of Plaintiff’s March 2025 payment (Check No. 2323), confirming receipt and physical possession of the asset, but claims she cannot produce the actual check in any form because it was “lost” by management.
- Subsequent to her July 28, 2026 demand, Defendant Gaines accepted Plaintiff’s August 1, 2026 lot rent payment in full.
- In September 2026, Defendant Gaines acted in overt bad faith by returning Plaintiff’s September 2026 rent check completely uncashed in a deliberate, artificial manipulation of the ledger designed to falsify a pathway for eviction.
- Since September 23, 2026, Defendant Gaines has engaged in an active campaign of intimidation, which includes sending harassing text messages, physically confronting the Plaintiff unannounced at his home while leveraging her authority as “the park manager,” leveling verbal eviction threats, and standing at the residence taking unauthorized photographs of the inside of the Plaintiff’s private mobile home.
COUNT I: INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS & INDIVIDUAL CIVIL TORT LIABILITY
(Against Defendant Saran Gaines, Individually)
- Plaintiff re-alleges paragraphs 1 through 15.
- The corporate shield doctrine does not insulate Defendant Gaines. Her personal actions—fabricating a 17-month-old debt, admitting to losing a processed check (Check #2323), intentionally rejecting a lawful tender of current rent to fake an eviction track, and capturing unauthorized photos of the inside of Plaintiff’s private residence—constitute independent, intentional tortious acts of fraud and harassment.
- This conduct is extreme, outrageous, goes far beyond the bounds of lawful property management, and was executed with the intention to cause severe emotional distress and force the Plaintiff from his home.
COUNT II: VIOLATION OF CHAPTER 723, FLA. STAT. (STATUTORY RETALIATION & BREACH OF GOOD FAITH)
(Against Defendant Pacifica Seminole MHP LLC)
- Plaintiff re-alleges paragraphs 1 through 15.
- Waiver: Under Florida law, Defendant’s acceptance of subsequent August 2026 rent after gaining knowledge of the alleged March 2025 default legally waived and extinguished any right to initiate an eviction action based on that historical period.
- Defective Notice: Rejscting Plaintiff’s lawful tender of September 2026 rent to manufacture a current default is a bad-faith distortion of the 5-day written demand notice requirement under Section 723.061(1)(a), Florida Statutes. A landlord cannot refuse rent and then claim a tenant failed to pay.
- Statutory Retaliation: The threat of eviction and the continuous manipulation of the tenant ledger are primarily retaliatory acts punishing the Plaintiff for raising infrastructure complaints, directly violating Section 723.0615, Florida Statutes.
- Breach of Good Faith: Defendants have violated the overarching obligation of good faith and fair dealing imposed on all mobile home tenancies by Chapter 723, Florida Statutes, and have breached the implied covenant of quiet enjoyment.
WHEREFORE, Plaintiff Christopher L. Winans respectfully requests this Court:
- Enter judgment for damages against Defendants, jointly and severally, in an amount exceeding $8,000 to be proven at trial;
- Grant Plaintiff leave to deposit ongoing disputed lot rental funds into the Court Registry pursuant to Fla. R. Civ. P. 1.600 and Section 723.063, Florida Statutes; and
- Issue a temporary and permanent injunction pursuant to Fla. R. Civ. P. 1.610 enjoining the Defendants and their agents from initiating eviction proceedings, entering Lot #210, or continuing to harass or photograph the Plaintiff at his residence.

Document Title: / AMENDED STATEMENT of Claim 2 Oct 2
“The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts, harassment, or bad-faith actions.”
The compounding actions taken by Manager Saran Gaines and Pacifica Seminole MHP LLC to fabricate a non-payment claim violate multiple procedural mandates, statutory requirements, and common-law doctrines under Florida law.
If this case goes before Judge Jagger, you can argue that the management’s actions directly violate the following laws and legal principles:
- Waiver of Right to Evict by Accepting Rent
Under long-standing Florida landlord-tenant and mobile home jurisprudence, a landlord’s acceptance of subsequent rent completely waives their right to evict for a prior known violation or non-payment.
- By accepting your August 1, 2026 lot rent after notifying you on July 28, 2026 about the alleged March 2025 missing rent, management legally waived and extinguished any right to use March 2025 as a basis for an eviction proceeding.
- Statutory Failure of 5-Day Written Demand Notice
Under Section 723.061(1)(a), Florida Statutes, a park owner can only initiate eviction for non-payment if they deliver a written demand and the default continues for 5 days after delivery. [1]
- Defective Notice & Itemization: Returning your September 2026 rent check uncashed in an attempt to artificially manufacture a current “non-payment” status is a bad-faith distortion of the statute. A landlord cannot refuse a lawful tender of rent and then claim the tenant failed to pay.
- Violation of Unlawful Retaliatory Conduct
Under Section 723.0615, Florida Statutes, it is strictly unlawful for a mobile home park owner to threaten or bring an action for possession primarily because they are retaliating against a homeowner. [1]
- Because you raised legitimate disputes and initiated legal proceedings regarding severe infrastructure and property defects, fabricating a stale, 17-month-old “lost check” claim and returning your current checks to force an eviction constitutes statutory retaliation.
- Violation of the Statutory Duty of Good Faith
Under Chapter 723, Florida Statutes (The Florida Mobile Home Act), every rental agreement and duty imposed by the Act enforces an obligation of good faith and fair dealings in its performance and enforcement. [1]
- Artificially manufacturing a ledger delinquency from nearly a year and a half prior—while possessing a photocopy showing the check was generated (Check #2323)—and then weaponizing it to threaten your tenancy violates this overarching duty of good faith.
- Common-Law Civil Torts: Intentional Interference and Fraud
- Fraudulent Misrepresentation / Falsification of Records: Presenting a photocopy of a check, admitting it was lost on their end, and then claiming the tenant “failed to pay” constitutes a fraudulent statement designed to deceive the court and bypass civil protections.
- Breach of the Covenant of Quiet Enjoyment: A landlord has a common-law contractual duty not to interfere with a tenant’s peaceable possession. Intentionally generating a fake eviction track to force a tenant out breaches this covenant.

- Defendant Pacifica Seminole MHP LLC is a Florida limited liability company doing business in Pinellas County, Florida.
- Defendant Saran Gaines is a resident of Pinellas County, Florida, and is sued in her individual capacity for independent, intentional tortious conduct committed outside the scope of legitimate property management duties.

- Plumbing failures and structural damages directly impacting Lot #210.
- These active, compounding infrastructure damages place the true amount in controversy above $8,000, requiring a transfer to the formal track of the County Court Civil Division.
COUNT I: INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS & HARASSMENT
(Against Defendant Saran Gaines, Individually)
- Plaintiff re-alleges paragraphs 1 through 8.
- Since September 23, 2026, Defendant Saran Gaines has engaged in an intentional campaign of extreme harassment and intimidation targeting the Plaintiff.
- Defendant Gaines has repeatedly sent harassing text messages demanding disputed rent amounts, physically confronted the Plaintiff unannounced at his residence, and leveraged her authority as “park manager” to threaten immediate eviction.
- Most egregiously, Defendant Gaines has engaged in an unlawful invasion of privacy by standing at the residence, leveling verbal threats, and actively taking unauthorized photographs of the inside of the Plaintiff’s private mobile home.
- This conduct is outrageous, goes far beyond the bounds of lawful property management, and has caused the Plaintiff severe emotional distress, anxiety, and the loss of quiet enjoyment of his property.
COUNT II: BREACH OF COVENANT OF QUIET ENJOYMENT & INJUNCTIVE RELIEF
(Against Defendant Pacifica Seminole MHP LLC)

- Plaintiff faces immediate, irreparable harm in the form of unlawful eviction and the potential loss of his home if the court does not intervene.

- Plaintiff re-alleges paragraphs 1 through 8
- Through the actions of its agent, Saran Gaines, Defendant Pacifica Seminole MHP has violated the law Under Florida Statutes Chapter 723 (The Florida Mobile Home Act), park owners have a statutory duty to maintain the common areas and utility infrastructure they control. If the Defendant Ms. Saran Gaines, knew about the grid surges and failed to repair them or warn residents, she has breached this duty.
Fraudulent Concealment / Intentional Nondisclosure:
- Plaintiff re-alleges paragraphs 1 through 8
- Through the actions of its agent, Saran Gaines, Defendant Pacifica Seminole MHP has Intentionally hiding a material fact (the dangerous power surges) that results in economic harm to a tenant allows the Plaintiff to sue a claim for damages, and potentially punitive damages if the concealment was malicious or reckless.
Breach of the Rental/Lease Agreement:
. 22. Plaintiff re-alleges paragraphs 1 through 8
- Mobile home park leases imply that the lot will be provided with safe, functional utility hookups. Systemic grid failures caused by park equipment breach that contract.
WHEREFORE, Plaintiff Christopher L. Winans respectfully requests this Court:
- Enter judgment for damages against Defendants, jointly and severally, in an amount exceeding $8,000 to be proven at trial;
- Grant Plaintiff leave to deposit all ongoing disputed lot rental funds into the Court Registry; and
- Issue an injunction enjoining the Defendants and their agents from initiating eviction proceedings or continuing to harass or photograph the Plaintiff at his private residence pending final resolution.

Legal Authority to amend
Your legal authority for these specific motions relies on a combination of Florida court rules and substantive state statutes.
- Motion for Leave to Amend & Transfer Division
- Florida Rule of Civil Procedure 1.190(a): This is the core procedural rule governing amendments. It explicitly mandates that “leave of court shall be given freely when justice so requires.” Florida courts heavily favor letting a case be decided on its factual merits rather than procedural errors, provided there is no prejudice to the defendant. [1, 2]
- Florida Small Claims Rule 7.100(d): This rule dictates what happens when a claim exceeds the monetary bounds of small claims. It states that if a counterclaim or an amendment exceeds the jurisdictional financial limit (which is $8,000 for small claims), the judge must transfer the action to the proper division of the County or Circuit Court. [1]
- Florida Small Claims Rule 7.020(b): This rule dictates that if a case is transferred out of Small Claims to the formal County Civil track, the Florida Rules of Civil Procedure immediately take over. [1]
- Motion to Deposit Funds into the Court Registry
- Florida Rule of Civil Procedure 1.600: This rule provides the direct mechanism for depositing disputed property or money. It states that when a party holds money that is the subject of the lawsuit, they may request leave of court to deposit all or part of that sum with the Clerk of Court, to be held in an interest-bearing registry until the judge determines who owns it.
- Section 723.063, Florida Statutes (The Florida Mobile Home Act): Under substantive Florida mobile home law, if a park owner brings an eviction action or a tenant defends against rent non-payment based on a material breach of the park’s statutory maintenance duties, the tenant is required by law to pay the disputed rent into the registry of the court to preserve their defense and protect their tenancy from immediate forfeiture.
- Motion for Injunctive Relief (Stopping Eviction & Harassment)
Florida Rule of Civil Procedure 1.610: This is the authority governing injunctions. It grants the court the power to issue temporary and permanent injunctions to prevent “irreparable injury, loss, or damage” before a full trial takes place. Your motion leverages this rule by demonstrating that an unjust eviction would result in the physical loss of your mobile home home

What is a response to a motion to dismiss a small claims case called
A response to a motion to dismiss is most commonly called a Plaintiff’s Response to Defendant’s Motion to Dismiss or an Opposition to the Motion to Dismiss.
Because small claims court rules are designed to be less formal, the exact formatting requirements can vary slightly depending on your specific county. However, the document generally serves the same purpose across jurisdictions:
📄 Standard Filing Titles
- Plaintiff’s Response to Defendant’s Motion to Dismiss
- Plaintiff’s Memorandum of Law in Opposition to Defendant’s Motion to Dismiss (Used if you are providing a detailed legal argument or referencing case law)
- Opposition to Motion to Dismiss
💡 Alternative Strategy: Motion for Leave to Amend
If the defendant’s motion points out a legitimate, easy-to-fix technical flaw in your lawsuit (such as a factual typo, an attached document issue, or naming the wrong entity), a common alternative strategy is to file a Motion for Leave to Amend the Complaint. Instead of arguing against the dismissal, this asks the judge for permission to file a corrected version of your lawsuit.
If you are currently drafting a response, let me know:
- What grounds or reasons did the defendant give for wanting to dismiss the case? (e.g., wrong court, past the statute of limitations, incorrect entity named)
- Which county or state is this small claims case filed in?
I can give you more specific details on standard deadlines or how to format your response argument.

Under Florida Small Claims Rule 7.070 and Florida Rule of Civil Procedure 1.190(a), the court allows amendments freely, but you must attach a complete copy of your proposed Amended Statement of Claim directly to the back of your motion.

- Denying Defendant’s Motion to Dismiss;
- Granting Plaintiff leave to file the attached Amended Statement of Claim; and
- Allowing Plaintiff an additional 120 days to execute proper service of process upon the Defendant’s Registered Agent: Paracorp Incorporated, 155 Office Plaza Dr, 1st Floor, Tallahassee, FL 32301.

Because your case is filed in Pinellas County but the registered agent (Paracorp Incorporated) is physically located in Tallahassee (Leon County), you must use a server with jurisdiction in Leon County. You have two primary options: using the official local Sheriff’s office or hiring a private certified process server.
Option 1: Leon County Sheriff’s Office (Civil Process Unit)

In case: 26-011919-SC in Small claims division What is the Form respnse to file: Motion for Leave to amend the Complaint in Case: 26-011919-SC, in Small Claims Division of the Pinellas County Court of the 6th Circuit Court, for Plaintiff’s response for motion to dismiss the property manager Saran Gaines as a defendant in the case. Although she has been threatening the Plaintiff regularly, acted in bad faith and threaten eviction unjustly.
There is no official pre-printed form provided by the court to oppose the dismissal of an individual defendant; you must file a customized, written Plaintiff’s Response in Opposition to Defendant’s Motion to Dismiss or an Amended Statement of Claim that explicitly details her individual liability.
Under Florida law, corporate employees and property managers can be held individually liable if they personally commit an intentional tort (such as civil harassment, civil theft, or intentional infliction of emotional distress) or act in bad faith outside the scope of standard corporate protections, even if they are acting on behalf of an LLC.
The template below can be customized to respond to the motion to dismiss Saran Gaines from Case No. 26-011919-SC.

PLAINTIFF’S RESPONSE IN OPPOSITION TO DEFENDANT SARAN GAINES’ MOTION TO DISMISS
Plaintiff, [Your Name], respectfully files this Response in Opposition to Defendant Saran Gaines’ Motion to Dismiss, and requests this Court deny the motion to dismiss her as a party to this action. In support, Plaintiff states:
- Defendant Saran Gaines moves to dismiss the claims against her individually under the assumption that she is protected as a mere agent or employee of Pacifica Seminole MHP LLC.
- Under established Florida law, an officer, agent, or employee of a corporation or LLC who commits or participates in an intentional tort or acts in bad faith is individually liable to the injured third party, regardless of whether they acted in a corporate capacity (Vesta Construction and Design, LLC v. Lotspeich & Associates, Inc.). Corporate status does not shield an individual from their own tortious acts or bad-faith conduct.
- Plaintiff’s claims against Defendant Gaines are based on her direct, personal, and intentional actions, which include:
- Engaging in regular, ongoing harassment and hostile threats against the Plaintiff.
- Actively acting in bad faith to disrupt the Plaintiff’s peaceful tenancy.
- Intentionally threatening the Plaintiff with unjust and unlawful evictions to cause distress and leverage compliance.
- These targeted, intentional actions go beyond the scope of ordinary, lawful property management duties and constitute independent individual misconduct.
- Dismissing Defendant Gaines at this early stage would severely prejudice the Plaintiff, as she is the central tortfeasor responsible for the face-to-face bad-faith conduct alleged in this dispute.
WHEREFORE, Plaintiff respectfully requests this Court enter an Order DENYING Defendant Saran Gaines’ Motion to Dismiss, requiring her to file an Answer to the Statement of Claim within ten (10) days, or alternatively, granting Plaintiff leave to file an Amended Statement of Claim to further articulate these individual tort claims.

💡 Procedural Tip for Your Hearing
When you attend the motion hearing before the Pinellas County judge, the defense attorney will likely argue the “corporate shield doctrine.” Your counter-argument should clearly state: “The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts, harassment, or bad-faith actions.”
If you want to strengthen this filing, let me know:
- Has she sent these threats to you in writing (text/email) or were they strictly verbal?
- Did she try to issue any official eviction notices (like a 3-day or 7-day notice), or were they just verbal threats?
I can help you weave those specific facts into the argument to ensure the judge keeps her in the case.

ORDER GRANTING LEAVE TO FILE FIRST AMENDED COMPLAINT AND TRANSFERRING ACTION TO THE COUNTY COURT CIVIL DIVISION
THIS CAUSE came before the Court upon Plaintiff Christopher L. Winans’ First Amended Motion for Leave to Amend Complaint and to Transfer Venue to the County Court Civil Division. The Court, having reviewed the motion, the records in this file, and noting that the active, compounding damages regarding the infrastructure issues (including systemic electrical, plumbing, and structural damage) place the true amount in controversy above the $8,000 small claims limit, finds that a transfer is appropriate to ensure proper assignment. It is therefore:
ORDERED AND ADJUDGED as follows:
Plaintiff’s First Amended Motion for Leave to File an Amended Complaint and Transfer Venue is GRANTED.
The Plaintiff is deemed to have leave of Court to file the First Amended Complaint. The First Amended Complaint attached to Plaintiff’s motion is hereby deemed filed as of the date of this Order.
The Clerk of the Circuit Court and Comptroller for Pinellas County is DIRECTED to immediately transfer and reassign this action from the Small Claims Division to the County Court Civil Division.
The Clerk shall update the judicial docket, modify the division track, and issue a standard County Civil case number suffix, if necessary, while preserving the core historical record of this case file.
This matter shall remain assigned to County Court Judge Edwin Jagger, who shall proceed to hear the case under the formal track of the Florida Rules of Civil Procedure rather than the Small Claims Rules.
To the extent required by the Clerk, the Plaintiff shall pay any operational transfer or civil reopen fees within twenty (20) days of the date of this Order, failing which this transfer order may be subject to review.

JUDGE: EDWIN JAGGER
PLAINTIFF’S FIRST AMENDED MOTION FOR LEAVE TO DEPOSIT FUNDS INTO THE COURT REGISTRY AND FOR INJUNCTIVE RELIEF
The Plaintiff, Christopher L. Winans, files this First Amended Motion for Leave to Deposit Funds into the Court Registry, and in support thereof states:
On September 23, 2026, Plaintiff filed a Motion for Leave to Create a Registry to securely hold disputed lot rental funds during the pendency of this litigation.
- Subsequent to that filing, urgent new events and material facts have occurred between the parties that further demonstrate an immediate, escalating need for judicial intervention and the establishment of a court registry.
NEW FACTUAL DEVELOPMENTS AND ESCALATING HARASSMENT
Plaintiff is the owner of the mobile home located on Lot #210 within the Defendant’s mobile home park park.
Since the filing of the original motion on September 23, the Defendant, through its park manager, has engaged in a campaign of active harassment and intimidation against the Plaintiff regarding a presumed non-payment of Lot #210 rent.
Specifically, the park manager has targeted the Plaintiff by:
Sending harassing text messages demanding payment for the disputed rent amounts.
Physically showing up at the Plaintiff’s front door unannounced, compromising the Plaintiff’s quiet enjoyment of the premises.
Verbally confronting the Plaintiff at his home under the guise of requesting a “solution,” expressly leveraging her authority by declaring that she is “the park manager.”
Most critically, the Defendant is now actively threatening eviction against the Plaintiff for the non-payment of the very lot rent that is central to the parties’ underlying legal dispute.
Plaintiff is ready, willing, and able to pay the required lot rent; however, due to the ongoing dispute regarding the severe property and infrastructure damages, the funds must be held by a neutral third party to protect both the Plaintiff’s property rights and the integrity of these legal proceedings.
If the Court does not grant leave to establish a registry, the Plaintiff faces the immediate threat of unlawful eviction and the potential loss of his mobile home home, causing irreparable harm.
WHEREFORE, Plaintiff, Christopher L. Winans, respectfully requests this Court enter an Order:
Granting Leave to deposit the ongoing, disputed monthly lot rent for Lot #210 into the Pinellas County Court Registry;
Directing the Clerk to maintain these funds in an interest-bearing account pending final resolution of this action; and
Enjoining the Defendant and its agents (including the park manager) from initiating any eviction proceedings or continuing to harass the Plaintiff at his residence while these funds are maintained in the registry. Defendant Saran Gaines continues verbal threat and taking photos of inside the mobile home .
To successfully amend your case and achieve all of your procedural goals, you must file a First Amended Statement of Claim (the actual lawsuit) alongside the documents you provided.
In Florida civil procedure, a Motion asks the judge to do something, an Order is what the judge signs, but the Amended Statement of Claim is the actual document that legally replaces your original lawsuit and sets your new damages above $8,000.
The customized template below integrates your specific facts—including the infrastructure damages, Saran Gaines’ personal actions (taking unauthorized photos inside your home, verbal threats), and the proper corporate name for the owner.
IN THE COUNTY COURT OF THE SIXTH JUDICIAL CIRCUIT
IN AND FOR PINELLAS COUNTY, FLORIDA
CHRISTOPHER L. WINANS,
Plaintiff,
vs.
SARAN GAINES, Individually, and
PACIFICA SEMINOLE MHP LLC,
Defendants.
CASE NO.: 26-011919-SC
DIVISION: Small Claims (Transfer Pending)
JUDGE: EDWIN JAGGER
PLAINTIFF’S FIRST AMENDED STATEMENT OF CLAIM
Plaintiff, Christopher L. Winans, sues Defendants, Saran Gaines, individually, and Pacifica Seminole MHP LLC (doing business as Seminole Mobile Home Park), and alleges:
JURISDICTION AND VENUE
- This is an action for damages and injunctive relief that exceeds the $8,000 jurisdictional limit of the Small Claims Division due to compounding, active structural and infrastructure damages. Jurisdiction is appropriate in the County Court Civil Division.
- Plaintiff Christopher L. Winans is a resident of Pinellas County, Florida, and owns a mobile home located on Lot #210 within the Seminole Mobile Home Park at 5015 Seminole Blvd, Seminole, FL 33772.
GENERAL ALLEGATIONS: INFRASTRUCTURE DEFECTS
- Plaintiff’s tenancy is governed by Chapter 723, Florida Statutes (The Florida Mobile Home Act).
- Under Florida law, the park owner has an non-delegable duty to maintain the park’s common areas and infrastructure in good, safe working order.
- The Defendant’s property suffers from systemic, severe infrastructure issues, including but not limited to:
- Systemic electrical defects posing immediate hazards.
- Plaintiff re-alleges paragraphs 1 through 8.
- Through the actions of its agent, Saran Gaines, Defendant Pacifica Seminole MHP LLC has breached the implied covenant of quiet enjoyment by subjecting the Plaintiff to an unsafe living environment and ongoing intimidation.
- The Defendant is actively threatening eviction for the non-payment of the very lot rent that is central to this underlying infrastructure litigation.
- Plaintiff faces immediate, irreparable harm in the form of unlawful eviction and the potential loss of his home if the court does not intervene.
WHEREFORE, Plaintiff Christopher L. Winans respectfully requests this Court:
- Enter judgment for damages against Defendants, jointly and severally, in an amount exceeding $8,000 to be proven at trial;

📋 Instructions for Preparing Your Filing Package
To file this properly in the Pinellas E-Filing Portal, save and upload your documents as three separate PDF files within the same submission window:
- Document 1 (The Motion): Upload the text you wrote titled PLAINTIFF’S FIRST AMENDED MOTION FOR LEAVE TO DEPOSIT FUNDS INTO THE COURT REGISTRY AND FOR INJUNCTIVE RELIEF.
- Document 2 (The Complaint/Exhibit): Upload the PLAINTIFF’S FIRST AMENDED STATEMENT OF CLAIM (provided above). You should label this document in the portal as an “Amended Complaint” or attach it to the motion as “Exhibit A”.
- Document 3 (The Proposed Order): Upload the text you wrote titled ORDER GRANTING LEAVE TO FILE FIRST AMENDED COMPLAINT…. Select “Proposed Order” as the document type so the clerk routes it directly to Judge Edwin Jagger’s electronic review queue.
Should First amended statement of claim name the Florida registered agent: The Florida registered agent for Pacifica Seminole MHP LLC (the owner of Seminole Mobile Home Park at 5015 Seminole Blvd.) is Paracorp Incorporated
Registered Office Address

as a defendant
No, you should not name the Registered Agent (Paracorp Incorporated) as a defendant [L19000250486].
A registered agent is simply a legal courier. They are the official point of contact designated to receive lawsuits on behalf of a company, but they have no personal liability, ownership, or operational involvement in your case [L19000250486]. Naming them as a defendant would cause the judge or defense counsel to immediately dismiss them from the lawsuit.
Instead, you name the business entity itself as the Defendant, and you list the Registered Agent on the Summons form as the entity where the process server must deliver the paperwork [L19000250486].
To format this correctly on the first page of your First Amended Statement of Claim and your Summons, write it like this:

what law supports these motions to amend the claim
Your legal authority for these specific motions relies on a combination of Florida court rules and substantive state statutes.
- Motion for Leave to Amend & Transfer Division
- Florida Rule of Civil Procedure 1.190(a): This is the core procedural rule governing amendments. It explicitly mandates that “leave of court shall be given freely when justice so requires.” Florida courts heavily favor letting a case be decided on its factual merits rather than procedural errors, provided there is no prejudice to the defendant.
- Florida Small Claims Rule 7.020(b): This rule dictates that if a case is transferred out of Small Claims to the formal County Civil track, the Florida Rules of Civil Procedure immediately take over.
- Florida Rule of Civil Procedure 1.610: This is the authority governing injunctions. It grants the court the power to issue temporary and permanent injunctions to prevent “irreparable injury, loss, or damage” before a full trial takes place. Your motion leverages this rule by demonstrating that an unjust eviction would result in the physical loss of your mobile home home.

Florida Small Claims Rules 2025
Rule 7.020. Applicability of Rules of Civil Procedure. Counterclaims; Setoffs; Third-Party Complaints; Transfer When Jurisdiction …
what law did the Mobile Home Park Manager violate when she fabricated a one month non payment of Lot Rent for Lot #210 for the month of March 2025, informing the Plaintiff of the missing Lot #210 rent for March 2025 in the Month of July, 28th 2026, subsequently accepting August 1 Lot rent then acting in paid faith and returning the September 2026 check uncashed to the defendant, thus falsifying a process for eviction, Manager Gaines, has produced a photo copy of the March 2025 check payment check number 2323, but can not produce the actual check in any form, stating it was lost,
The compounding actions taken by Manager Saran Gaines and Pacifica Seminole MHP LLC to fabricate a non-payment claim violate multiple procedural mandates, statutory requirements, and common-law doctrines under Florida law.
Would you like help drafting a Formal Motion for Sanctions for Bad-Faith Litigation to file alongside your amended complaint, or would you like me to show you how to weave this timeline into the Factual Allegations section of your Amended Statement of Claim?

To make your Response in Opposition to Defendant Saran Gaines’ Motion to Dismiss legally lethal, you need to weave this specific timeline directly into the text. This proves to Judge Jagger that she isn’t just a corporate employee doing her job—she is an active participant in fraud, retaliation, and bad-faith record falsification.
Here are the exact changes and additions you should insert into the body of your Response:
- Update the “General Allegations” Section
Add these specific factual bullet points to paragraph 3 of your response to outline her direct, personal misconduct:
- Fabrication of Stale Debt: Defendant Gaines actively fabricated a completely fraudulent one-month lot rent delinquency for March 2025, waiting a staggering 17 months until July 28, 2026, to notify the Plaintiff of this alleged “missing” rent.
- Destruction or Loss of Evidence: Defendant Gaines produced a physical photocopy of Plaintiff’s March 2025 rent check (Check #2323)—proving she received it—but admits she lost the check on her end and is now deceptively using her own administrative error to allege “non-payment.”
- Manufactured Eviction Process & Rejection of Lawful Tender: Defendant Gaines accepted Plaintiff’s August 1, 2026 rent check, but subsequently acted in active bad faith by returning Plaintiff’s September 2026 rent check completely uncashed. This was a deliberate, artificial manipulation of the tenant ledger designed to illegally manufacture a current default and falsify a pathway for eviction.
- Insert a Section on Florida Case Law Regarding “Waiver”
Add a brand new legal paragraph (Paragraph 4) to directly address her bad-faith eviction tactics under Florida law:
- Statutory Waiver & Bad Faith: Under long-standing Florida jurisprudence, a landlord’s acceptance of subsequent rent completely waives their right to evict for any prior known non-payment. By accepting Plaintiff’s August 1, 2026 rent, Defendant Gaines legally extinguished any right to leverage a March 2025 claim. Furthermore, her intentional rejection of Plaintiff’s lawful tender of September 2026 rent directly violates the statutory obligation of Good Faith and Fair Dealing imposed by Chapter 723, Florida Statutes.
- Strengthen your Argument Against the “Corporate Shield”
Modify your main legal argument paragraph to directly tie her actions to individual tort liability (Fraud and Retaliation):
- The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts. Defendant Gaines’ actions—falsifying a ledger, admitting to losing a processed check (Check #2323), refusing current lawful rent tenders, and launching an illegal, retaliatory eviction track under Section 723.0615, Florida Statutes—constitute independent, intentional fraudulent misrepresentation and civil harassment. She is the central tortfeasor, and dismissing her would severely prejudice the Plaintiff.
💡 Pro-Tip for Filing:
When you file this modified response into the portal, make sure to attach a copy of Check #2323’s photocopy (if you have it) as “Exhibit A” to this response. Showing Judge Jagger that she actually has a photocopy of your check completely destroys her argument that you didn’t pay.

IN THE COUNTY COURT OF THE SIXTH JUDICIAL CIRCUIT
IN AND FOR PINELLAS COUNTY, FLORIDA
CHRISTOPHER L. WINANS,
Plaintiff,
v.
SARAN GAINES, PACIFICA SEMINOLE MHP, CORPORATE HEADQUARTERS,
Defendant.
CASE NO.: 26-011919-SC
DIVISION: SMALL CLAIMS
JUDGE: EDWIN JAGGER
- Plaintiff’s First Amended Motion for Leave to File an Amended Complaint and Transfer Venue is GRANTED.
- The Plaintiff is deemed to have leave of Court to file the First Amended Complaint. The First Amended Complaint attached to Plaintiff’s motion is hereby deemed filed as of the date of this Order.
- The Clerk of the Circuit Court and Comptroller for Pinellas County is DIRECTED to immediately transfer and reassign this action from the Small Claims Division to the County Court Civil Division.
- The Clerk shall update the judicial docket, modify the division track, and issue a standard County Civil case number suffix, if necessary, while preserving the core historical record of this case file.
- This matter shall remain assigned to County Court Judge Edwin Jagger, who shall proceed to hear the case under the formal track of the Florida Rules of Civil Procedure rather than the Small Claims Rules.
- To the extent required by the Clerk, the Plaintiff shall pay any operational transfer or civil reopen fees within twenty (20) days of the date of this Order, failing which this transfer order may be subject to review.
DONE AND ORDERED in Chambers at Pinellas County, Florida on this _____ day of ______________, 2026.

CASE NO.: 26-011919-SC DIVISION: Small Claims PLAINTIFF’S MOTION FOR LEAVE TO AMEND THE COMPLAINT AND MEMORANDUM IN OPPOSITION TO DEFENDANT’S MOTION TO DISMISS Plaintiff, [Your Name], respectfully moves this Court pursuant to Florida Rule of Civil Procedure 1.190(a) and Florida Small Claims Rules for an Order granting leave to amend the initial Statement of Claim. In support, Plaintiff states: Plaintiff filed the initial Statement of Claim in this action on [Date you filed]. Defendant filed a Motion to Dismiss alleging improper service of process, noting that service was delivered directly to the physical business location rather than to Defendant’s designated Florida Registered Agent. Plaintiff recognizes this technical defect and seeks to cure the service issue immediately. Justice requires that the case be decided on its merits rather than a technical service error. Leave to amend “shall be given freely when justice so requires” under Fla. R. Civ. P. 1.190(a). Granting this motion will not prejudice the Defendant, as the case is in its earliest stages, no trial date has been set, and the amendment serves only to properly identify and serve the correct Registered Agent entity. Attached hereto as Exhibit A is the proposed Amended Statement of Claim correctly identifying the Defendant and its Registered Agent for formal service of process. WHEREFORE, Plaintiff respectfully requests this Court enter an Order: Denying Defendant’s Motion to Dismiss; Granting Plaintiff leave to file the attached Amended Statement of Claim; and Allowing Plaintiff an additional 120 days to execute proper service of process upon the Defendant’s Registered Agent: Paracorp Incorporated, 155 Office Plaza Dr, 1st Floor, Tallahassee, FL 32301. IN THE COUNTY COURT OF THE SIXTH JUDICIAL CIRCUIT IN AND FOR PINELLAS COUNTY, FLORIDA CHRISTOPHER L. WINANS, Plaintiff, vs. SARAN GAINES, Individually, and PACIFICA SEMINOLE MHP LLC, Defendants. CASE NO.: 26-011919-SC DIVISION: County Civil Division (Transfer Pending) JUDGE: EDWIN JAGGER PLAINTIFF’S FIRST AMENDED STATEMENT OF CLAIM Plaintiff, Christopher L. Winans, sues Defendants, Saran Gaines, individually, and Pacifica Seminole MHP LLC (doing business as Seminole Mobile Home Park), and alleges: JURISDICTION AND VENUE This is an action for damages, statutory violations, and injunctive relief that exceeds the $8,000 jurisdictional limit of the Small Claims Division due to compounding, active structural and infrastructure damages. Pursuant to Florida Small Claims Rule 7.100(d), this action is subject to immediate transfer to the formal track of the County Court Civil Division. Plaintiff Christopher L. Winans is a resident of Pinellas County, Florida, and owns a mobile home located on Lot #210 within the Seminole Mobile Home Park at 5015 Seminole Blvd, Seminole, FL 33772. Defendant Pacifica Seminole MHP LLC is a Florida limited liability company doing business in Pinellas County, Florida, and is the owner of the park [L19000250486]. Defendant Saran Gaines is a resident of Pinellas County, Florida, and is the physical park manager. She is sued in her individual capacity. The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts, harassment, or bad-faith actions (Vesta Construction and Design, LLC v. Lotspeich & Associates, Inc.). GENERAL ALLEGATIONS: INFRASTRUCTURE DEFECTS Plaintiff’s tenancy is governed by Chapter 723, Florida Statutes (The Florida Mobile Home Act). Under Florida law, the park owner has a non-delegable duty to maintain the park’s common areas and infrastructure in good, safe working order. The Defendant’s property suffers from systemic, severe infrastructure issues, including but not limited to, systemic electrical defects posing immediate hazards, plumbing failures, and structural damages directly impacting Lot #210. These active, compounding infrastructure damages place the true amount in controversy above $8,000, invoking the formal track of the Florida Rules of Civil Procedure pursuant to Florida Small Claims Rule 7.020(b). III. FACTUAL ALLEGATIONS: FABRICATED DELINQUENCY & HARASSMENT On September 23, 2026, Plaintiff filed a motion to securely hold disputed lot rental funds due to these unaddressed infrastructure defects. In retaliation, Defendant Saran Gaines fabricated a fraudulent one-month lot rent non-payment claim regarding Lot #210 for the month of March 2025—a period spanning 17 months prior. Defendant Gaines first informed the Plaintiff of this alleged missing March 2025 rent on July 28, 2026. Defendant Gaines has produced a photocopy of Plaintiff’s March 2025 payment (Check No. 2323), confirming receipt and physical possession of the asset, but claims she cannot produce the actual check in any form because it was “lost” by management. Subsequent to her July 28, 2026 demand, Defendant Gaines accepted Plaintiff’s August 1, 2026 lot rent payment in full. In September 2026, Defendant Gaines acted in overt bad faith by returning Plaintiff’s September 2026 rent check completely uncashed in a deliberate, artificial manipulation of the ledger designed to falsify a pathway for eviction. Since September 23, 2026, Defendant Gaines has engaged in an active campaign of intimidation, which includes sending harassing text messages, physically confronting the Plaintiff unannounced at his home while leveraging her authority as “the park manager,” leveling verbal eviction threats, and standing at the residence taking unauthorized photographs of the inside of the Plaintiff’s private mobile home. COUNT I: INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS & INDIVIDUAL CIVIL TORT LIABILITY (Against Defendant Saran Gaines, Individually) Plaintiff re-alleges paragraphs 1 through 15. The corporate shield doctrine does not insulate Defendant Gaines. This conduct is extreme, outrageous, goes far beyond the bounds of lawful property management, and was executed with the intention to cause severe emotional distress and force the Plaintiff from his home. COUNT II: VIOLATION OF CHAPTER 723, FLA. STAT. (STATUTORY RETALIATION & BREACH OF GOOD FAITH) (Against Defendant Pacifica Seminole MHP LLC) Plaintiff re-alleges paragraphs 1 through 15. Waiver: Under Florida law, Defendant’s acceptance of subsequent August 2026 rent after gaining knowledge of the alleged March 2025 default legally waived and extinguished any right to initiate an eviction action based on that historical period. Defective Notice: Rejscting Plaintiff’s lawful tender of September 2026 rent to manufacture a current default is a bad-faith distortion of the 5-day written demand notice requirement under Section 723.061(1)(a), Florida Statutes. A landlord cannot refuse rent and then claim a tenant failed to pay. Statutory Retaliation: The threat of eviction and the continuous manipulation of the tenant ledger are primarily retaliatory acts punishing the Plaintiff for raising infrastructure complaints, directly violating Section 723.0615, Florida Statutes. Breach of Good Faith: Defendants have violated the overarching obligation of good faith and fair dealing imposed on all mobile home tenancies by Chapter 723, Florida Statutes, and have breached the implied covenant of quiet enjoyment. WHEREFORE, Plaintiff Christopher L. Winans respectfully requests this Court: Enter judgment for damages against Defendants, jointly and severally, in an amount exceeding $8,000 to be proven at trial; Grant Plaintiff leave to deposit ongoing disputed lot rental funds into the Court Registry pursuant to Fla. R. Civ. P. 1.600 and Section 723.063, Florida Statutes; and Issue a temporary and permanent injunction pursuant to Fla. R. Civ. P. 1.610 enjoining the Defendants and their agents from initiating eviction proceedings, entering Lot #210, or continuing to harass or photograph the Plaintiff at his residence. Dated: October 2, 2026. Respectfully submitted, Christopher L. Winans 5015 Seminole Blvd, Lot #210 Seminole, FL 33772 727.947.0067 clw4422@gmail.com CERTIFICATE OF SERVICE I HEREBY CERTIFY that a true and correct copy of the foregoing has been furnished via the Florida Courts E-Filing Portal to the Defendant’s attorney of record on this 2nd day of October, 2026. Christopher L. Winans Document Title: version 1 SEE VERSION (E) Document Title: / AMENDED STATEMENT of Claim 2 Oct 2 OCT 2, Original to Doc. E DOCUMENT: [ 1 E (XYZ)] / version 2 Document # 1 E / OCT 3 , NEW statement of clam / Date: Oct 04, 2026 / By: Rato de Advogado / Document: Court Filing / THE LAW – BASE FORM A To Which It Stands: ” War at Lot 210 / The War At Lot #210 – ‘To Which It Stands Document # 1 E (XYZ) Document Title: / AMENDED STATEMENT of Claim 2 Oct 2 “The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts, harassment, or bad-faith actions.” The compounding actions taken by Manager Saran Gaines and Pacifica Seminole MHP LLC to fabricate a non-payment claim violate multiple procedural mandates, statutory requirements, and common-law doctrines under Florida law. If this case goes before Judge Jagger, you can argue that the management’s actions directly violate the following laws and legal principles: Waiver of Right to Evict by Accepting Rent Under long-standing Florida landlord-tenant and mobile home jurisprudence, a landlord’s acceptance of subsequent rent completely waives their right to evict for a prior known violation or non-payment. By accepting your August 1, 2026 lot rent after notifying you on July 28, 2026 about the alleged March 2025 missing rent, management legally waived and extinguished any right to use March 2025 as a basis for an eviction proceeding. Statutory Failure of 5-Day Written Demand Notice Under Section 723.061(1)(a), Florida Statutes, a park owner can only initiate eviction for non-payment if they deliver a written demand and the default continues for 5 days after delivery. [1] Defective Notice & Itemization: Returning your September 2026 rent check uncashed in an attempt to artificially manufacture a current “non-payment” status is a bad-faith distortion of the statute. A landlord cannot refuse a lawful tender of rent and then claim the tenant failed to pay. Violation of Unlawful Retaliatory Conduct Under Section 723.0615, Florida Statutes, it is strictly unlawful for a mobile home park owner to threaten or bring an action for possession primarily because they are retaliating against a homeowner. [1] Because you raised legitimate disputes and initiated legal proceedings regarding severe infrastructure and property defects, fabricating a stale, 17-month-old “lost check” claim and returning your current checks to force an eviction constitutes statutory retaliation. Violation of the Statutory Duty of Good Faith Under Chapter 723, Florida Statutes (The Florida Mobile Home Act), every rental agreement and duty imposed by the Act enforces an obligation of good faith and fair dealings in its performance and enforcement. [1] Artificially manufacturing a ledger delinquency from nearly a year and a half prior—while possessing a photocopy showing the check was generated (Check #2323)—and then weaponizing it to threaten your tenancy violates this overarching duty of good faith. Common-Law Civil Torts: Intentional Interference and Fraud Fraudulent Misrepresentation / Falsification of Records: Presenting a photocopy of a check, admitting it was lost on their end, and then claiming the tenant “failed to pay” constitutes a fraudulent statement designed to deceive the court and bypass civil protections. Breach of the Covenant of Quiet Enjoyment: A landlord has a common-law contractual duty not to interfere with a tenant’s peaceable possession. Intentionally generating a fake eviction track to force a tenant out breaches this covenant. Would you like help drafting a Formal Motion for Sanctions for Bad-Faith Litigation to file alongside your amended complaint, or would you like me to show you how to weave this timeline into the Factual Allegations section of your Amended Statement of Claim? IN THE COUNTY COURT OF THE SIXTH JUDICIAL CIRCUIT IN AND FOR PINELLAS COUNTY, FLORIDA CHRISTOPHER L. WINANS, Plaintiff, vs. SARAN GAINES, Individually, and PACIFICA SEMINOLE MHP LLC , Defendants. CASE NO.: 26-011919-SC DIVISION: Small Claims (Transfer Pending) JUDGE: EDWIN JAGGER PLAINTIFF’S FIRST AMENDED STATEMENT OF CLAIM Plaintiff, Christopher L. Winans, sues Defendants, Saran Gaines, individually, and Pacifica Seminole MHP LLC (doing business as Seminole Mobile Home Park), and alleges: JURISDICTION AND VENUE This is an action for damages and injunctive relief that exceeds the $8,000 jurisdictional limit of the Small Claims Division due to compounding, active structural and infrastructure damages. Jurisdiction is appropriate in the County Court Civil Division. Plaintiff Christopher L. Winans is a resident of Pinellas County, Florida, and owns a mobile home located on Lot #210 within the Seminole Mobile Home Park at 5015 Seminole Blvd, Seminole, FL 33772. Defendant Pacifica Seminole MHP LLC is a Florida limited liability company doing business in Pinellas County, Florida. Defendant Saran Gaines is a resident of Pinellas County, Florida, and is sued in her individual capacity for independent, intentional tortious conduct committed outside the scope of legitimate property management duties. GENERAL ALLEGATIONS: INFRASTRUCTURE DEFECTS Plaintiff’s tenancy is governed by Chapter 723, Florida Statutes (The Florida Mobile Home Act). Under Florida law, the park owner has an non-delegable duty to maintain the park’s common areas and infrastructure in good, safe working order. The Defendant’s property suffers from systemic, severe infrastructure issues, including but not limited to: Systemic electrical defects posing immediate hazards. Plumbing failures and structural damages directly impacting Lot #210. These active, compounding infrastructure damages place the true amount in controversy above $8,000, requiring a transfer to the formal track of the County Court Civil Division. COUNT I: INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS & HARASSMENT (Against Defendant Saran Gaines, Individually) Plaintiff re-alleges paragraphs 1 through 8. Since September 23, 2026, Defendant Saran Gaines has engaged in an intentional campaign of extreme harassment and intimidation targeting the Plaintiff. Defendant Gaines has repeatedly sent harassing text messages demanding disputed rent amounts, physically confronted the Plaintiff unannounced at his residence, and leveraged her authority as “park manager” to threaten immediate eviction. Most egregiously, Defendant Gaines has engaged in an unlawful invasion of privacy by standing at the residence, leveling verbal threats, and actively taking unauthorized photographs of the inside of the Plaintiff’s private mobile home. This conduct is outrageous, goes far beyond the bounds of lawful property management, and has caused the Plaintiff severe emotional distress, anxiety, and the loss of quiet enjoyment of his property. COUNT II: BREACH OF COVENANT OF QUIET ENJOYMENT & INJUNCTIVE RELIEF (Against Defendant Pacifica Seminole MHP LLC) Plaintiff re-alleges paragraphs 1 through 8. Through the actions of its agent, Saran Gaines, Defendant Pacifica Seminole MHP LLC has breached the implied covenant of quiet enjoyment by subjecting the Plaintiff to an unsafe living environment and ongoing intimidation. The Defendant is actively threatening eviction for the non-payment of the very lot rent that is central to this underlying infrastructure litigation. Plaintiff faces immediate, irreparable harm in the form of unlawful eviction and the potential loss of his home if the court does not intervene. Negligence & Failure to Maintain: Plaintiff re-alleges paragraphs 1 through 8 Through the actions of its agent, Saran Gaines, Defendant Pacifica Seminole MHP has violated the law Under Florida Statutes Chapter 723 (The Florida Mobile Home Act), park owners have a statutory duty to maintain the common areas and utility infrastructure they control. If the Defendant Ms. Saran Gaines, knew about the grid surges and failed to repair them or warn residents, she has breached this duty. Fraudulent Concealment / Intentional Nondisclosure: Plaintiff re-alleges paragraphs 1 through 8 Through the actions of its agent, Saran Gaines, Defendant Pacifica Seminole MHP has Intentionally hiding a material fact (the dangerous power surges) that results in economic harm to a tenant allows the Plaintiff to sue a claim for damages, and potentially punitive damages if the concealment was malicious or reckless. Breach of the Rental/Lease Agreement: . 22. Plaintiff re-alleges paragraphs 1 through 8 Mobile home park leases imply that the lot will be provided with safe, functional utility hookups. Systemic grid failures caused by park equipment breach that contract. WHEREFORE, Plaintiff Christopher L. Winans respectfully requests this Court: Enter judgment for damages against Defendants, jointly and severally, in an amount exceeding $8,000 to be proven at trial; Grant Plaintiff leave to deposit all ongoing disputed lot rental funds into the Court Registry; and Issue an injunction enjoining the Defendants and their agents from initiating eviction proceedings or continuing to harass or photograph the Plaintiff at his private residence pending final resolution. Would you like help drafting a Formal Motion for Sanctions for Bad-Faith Litigation to file alongside your amended complaint, or would you like me to show you how to weave this timeline into the Factual Allegations section of your Amended Statement of Claim? what law did the Mobile Home Park Manager violate when she fabricated a one month non payment of Lot Rent for Lot #210 for the month of March 2025, informing the Plaintiff of the missing Lot #210 rent for March 2025 in the Month of July, 28th 2026, subsequently accepting August 1 Lot rent then acting in paid faith and returning the September 2026 check uncashed to the defendant, thus falsifying a process for eviction, Manager Gaines, has produced a photo copy of the March 2025 check payment check number 2323, but can not produce the actual check in any form, stating it was lost, DEFENDANT TO BE SERVED: Pacifica Seminole MHP LLC c/o Paracorp Incorporated, Registered Agent 155 Office Plaza Dr, 1st Floor Tallahassee, FL 32301 Legal Authority to amend Your legal authority for these specific motions relies on a combination of Florida court rules and substantive state statutes. Motion for Leave to Amend & Transfer Division Florida Rule of Civil Procedure 1.190(a): This is the core procedural rule governing amendments. It explicitly mandates that “leave of court shall be given freely when justice so requires.” Florida courts heavily favor letting a case be decided on its factual merits rather than procedural errors, provided there is no prejudice to the defendant. [1, 2] Florida Small Claims Rule 7.100(d): This rule dictates what happens when a claim exceeds the monetary bounds of small claims. It states that if a counterclaim or an amendment exceeds the jurisdictional financial limit (which is $8,000 for small claims), the judge must transfer the action to the proper division of the County or Circuit Court. [1] Florida Small Claims Rule 7.020(b): This rule dictates that if a case is transferred out of Small Claims to the formal County Civil track, the Florida Rules of Civil Procedure immediately take over. [1] Motion to Deposit Funds into the Court Registry Florida Rule of Civil Procedure 1.600: This rule provides the direct mechanism for depositing disputed property or money. It states that when a party holds money that is the subject of the lawsuit, they may request leave of court to deposit all or part of that sum with the Clerk of Court, to be held in an interest-bearing registry until the judge determines who owns it. Section 723.063, Florida Statutes (The Florida Mobile Home Act): Under substantive Florida mobile home law, if a park owner brings an eviction action or a tenant defends against rent non-payment based on a material breach of the park’s statutory maintenance duties, the tenant is required by law to pay the disputed rent into the registry of the court to preserve their defense and protect their tenancy from immediate forfeiture. Motion for Injunctive Relief (Stopping Eviction & Harassment) Florida Rule of Civil Procedure 1.610: This is the authority governing injunctions. It grants the court the power to issue temporary and permanent injunctions to prevent “irreparable injury, loss, or damage” before a full trial takes place. Your motion leverages this rule by demonstrating that an unjust eviction would result in the physical loss of your mobile home home Document Title: THE BIG Enchilada / DOCUMENT 1 G Document # 1 G THE BIG Enchilada / Date: Oct 04, 2026 / By: Rato de Advogado / Document: THE LAW – BASE FORM A To Which It Stands: ” War at Lot 210 / The War At Lot #210 – ‘To Which It Stands Document # 1 G: THE BIG Enchilada Document Title: / Date: Oct 04, 2026 / By: Rato de Advogado / Document: / THE LAW – BASE FORM A To Which It Stands: ” War at Lot 210 / The War At Lot #210 – ‘To Which It Stands THE BIG Enchilada ….. against dismiss motions EVERYTHING The Florida registered agent for Pacifica Seminole MHP LLC (the owner of Seminole Mobile Home Park at 5015 Seminole Blvd.) is Paracorp Incorporated. ASHOK I… What is a response to a motion to dismiss a small claims case called A response to a motion to dismiss is most commonly called a Plaintiff’s Response to Defendant’s Motion to Dismiss or an Opposition to the Motion to Dismiss. Because small claims court rules are designed to be less formal, the exact formatting requirements can vary slightly depending on your specific county. However, the document generally serves the same purpose across jurisdictions: 📄 Standard Filing Titles Plaintiff’s Response to Defendant’s Motion to Dismiss Plaintiff’s Memorandum of Law in Opposition to Defendant’s Motion to Dismiss (Used if you are providing a detailed legal argument or referencing case law) Opposition to Motion to Dismiss 💡 Alternative Strategy: Motion for Leave to Amend If the defendant’s motion points out a legitimate, easy-to-fix technical flaw in your lawsuit (such as a factual typo, an attached document issue, or naming the wrong entity), a common alternative strategy is to file a Motion for Leave to Amend the Complaint. Instead of arguing against the dismissal, this asks the judge for permission to file a corrected version of your lawsuit. If you are currently drafting a response, let me know: What grounds or reasons did the defendant give for wanting to dismiss the case? (e.g., wrong court, past the statute of limitations, incorrect entity named) Which county or state is this small claims case filed in? IN THE COUNTY COURT OF THE SIXTH JUDICIAL CIRCUIT IN AND FOR PINELLAS COUNTY, FLORIDA [YOUR NAME], Plaintiff, vs. PACIFICA SEMINOLE MHP LLC, and SARAN GAINES, individually, Defendants. CASE NO.: 26-011919-SC DIVISION: Small Claims PLAINTIFF’S RESPONSE IN OPPOSITION TO DEFENDANT SARAN GAINES’ MOTION TO DISMISS Plaintiff, [Your Name], respectfully files this Response in Opposition to Defendant Saran Gaines’ Motion to Dismiss, and requests this Court deny the motion to dismiss her as a party to this action. In support, Plaintiff states: Defendant Saran Gaines moves to dismiss the claims against her individually under the assumption that she is protected as a mere agent or employee of Pacifica Seminole MHP LLC. Under established Florida law, an officer, agent, or employee of a corporation or LLC who commits or participates in an intentional tort or acts in bad faith is individually liable to the injured third party, regardless of whether they acted in a corporate capacity (Vesta Construction and Design, LLC v. Lotspeich & Associates, Inc.). Corporate status does not shield an individual from their own tortious acts or bad-faith conduct. Plaintiff’s claims against Defendant Gaines are based on her direct, personal, and intentional actions, which include: Engaging in regular, ongoing harassment and hostile threats against the Plaintiff. Actively acting in bad faith to disrupt the Plaintiff’s peaceful tenancy. Intentionally threatening the Plaintiff with unjust and unlawful evictions to cause distress and leverage compliance. These targeted, intentional actions go beyond the scope of ordinary, lawful property management duties and constitute independent individual misconduct. Dismissing Defendant Gaines at this early stage would severely prejudice the Plaintiff, as she is the central tortfeasor responsible for the face-to-face bad-faith conduct alleged in this dispute. [Your Signature] 💡 Procedural Tip for Your Hearing When you attend the motion hearing before the Pinellas County judge, the defense attorney will likely argue the “corporate shield doctrine.” Your counter-argument should clearly state: “The corporate shield doctrine does not protect an individual manager in Florida from being sued for their own active, personal torts, harassment, or bad-faith actions.” If you want to strengthen this filing, let me know: Has she sent these threats to you in writing (text/email) or were they strictly verbal? Did she try to issue any official eviction notices (like a 3-day or 7-day notice), or were they just verbal threats? I can help you weave those specific facts into the argument to ensure the judge keeps her in the case. AI responses may include mistakes. For legal advice, consult a professional.
